Understanding Felony Classes

Illinois law breaks felony charges into 5 different classes, and potential sentencing is influenced by the class under which the offense falls.

Class X

  • Most serious type of offense, which can include such charges as aggravated sexual assault, aggravated vehicular hijacking, or solicitation of murder
  • Fines up to $25,000
  • Imprisonment in a state penitentiary for 6 to 30 years

Class 1

  • Includes such offenses as drug manufacturing, criminal sexual assault, kidnapping, and possession of such drugs as cocaine, heroin, or meth
  • Fines up to $25,000
  • Imprisonment in a state penitentiary for 4 to 15 years

Class 2

  • Includes such crimes as arson, possession of certain types of drugs, theft, and certain white collar crimes
  • Fines up to $25,000
  • Imprisonment in state penitentiary for 3 to 7 years

Class 3

  • Includes offenses like aggravated DUI, drug possession, and aggravated battery
  • Fines up to $25,000
  • Imprisonment in a state penitentiary for 2 to 5 years

Class 4

  • Includes such crimes as aggravated assault, stalking, DUI, and possession of certain types of drugs
  • Fines up to $25,000
  • Imprisonment in a state penitentiary for 1 to 3 years
