Under Illinois Law, a person will face robbery charges if he or she “takes property from the person or presence of another by the use of force or by threatening the imminent use of force” (720 ILCS 5/18 1).

Aggravated Robbery: a person will be charged with aggravated robbery when they take property from another person or place by the use of force or by threatening imminent force with a weapon, which can include a firearm, knife, ax, bludgeon, etc.   Even if the defendant didn’t have a weapon in their possession during the commission of the robbery, he or she can still face aggravated robbery charges if they in any way implied that they had a weapon and intended to use it.  

Armed Robbery:  under Illinois law, a person will be charged with armed robbery if, during the commission of the robbery, he or she is armed with a dangerous weapon. 

Penalties for Robbery in Chicago

Robbery charges can lead to a number of legal penalties upon conviction, including 3 to 7 years in Illinois state prison, probation, large fines, community service, restitution to the victim, permanent criminal record, and more.  In some extreme cases, robbery charges can result in 7 to 14 years in prison.

When a person commits robbery in a school or a place of worship, or if the victim is physically handicapped or over the age of 60, the defendant will face Class 1 Felony charges.  These are much more serious robbery charges that are punishable by anywhere from 4 to 60 years in state prison, without the possibility of probation.

Under Illinois Law, aggravated robbery is a Class 1 felony that is punishable by 4 to 30 years in state prison.  Armed robbery is a Class X felony that carries a mandatory sentence of 6 to 60 years in prison.
