An Overview of Breath and Blood Tests

While the results of these tests are often used by prosecution, this method of measuring a driver's BAC is often very flawed. In many cases, the arresting officer improperly administers the test, and the machines are known to malfunction if they do not receive routine maintenance.

Blood Tests

The other test commonly used to determine BAC is a blood test. The driver's blood is drawn at the police station or an approved laboratory. The sample is then analyzed by a trained technician to determine the driver's BAC. This evidence is not foolproof, as laboratory staff can contaminate the sample by a failure to follow standard procedures, mislabeling the samples, or making other mistakes.
